LEWIS, Circuit Judge.

The defendant appeals from a judgment entered on a jury verdict finding him guilty of mail fraud in violation of 18 U.S.C. § 1341. The issues leading to this appeal involve various alleged procedural irregularities in the choosing and empaneling of *689juries during the course of defendant’s prosecution.

Phillips was originally scheduled to stand trial on August 2, 1976. Two days before his trial a jury whs routinely selected but not sworn. On the scheduled day of trial the court granted a continuance until September 13 to allow the prosecutor to produce two unavailable key…
