The defendant, Irvin Bernell, was charged in the district court of Stephens county with the crime of murder, was tried, convicted, and sentenced to life imprisonment in the State Penitentiary, and has- appealed. The charging part of the information filed against the defendant reads as follows:

“That the said Irvin C. Bernell, late of Stephens County, Oklahoma, and within the jurisdiction of this Court, then and there being, did then and there willfully, unlawfully, wrongfully and feloniously, without authority of law and with a premeditated design to effect the death of Hazel Bernell, Ruby…
