WILKERSON, District Judge.
Plaintiff, a citizen of Michigan, brings suit against defendants, who are citizens’of Illinois, to enforce as against the defendants John J. Foley and James P. Foley his claim *794under the dower act of Illinois to a portion of an estate in the possession of defendant Chicago Title & Trust Company, administrator, growing out of his renunciation in the probate court of Cook county of the provisions of the will of his deceased wife. The questions involved are presented properly by the pleadings, and I shall proceed to state the facts.
