MEMORANDUM OPINION
ROBERT E. NUGENT, Chief Judge.
W. Terrence Brown, chapter 11 trustee of the bankruptcy estate of Hertzler Hal-stead Hospital Corporation, sued Leslie Kitchenmaster and his company, KOT, Inc., under 11 U.S.C. § 547 and § 548 to avoid and recover alleged preferential and fraudulent transfers made to them by the debtor prior to the date of debtor’s bankruptcy petition. 1 This Court appointed Mr. Brown chapter 11 trustee in this case on January 10, 2003 on the joint motion of the debtor and the Official Unsecured Creditors Committee after significant financial irregularities in…
