The plaintiff had been for some years before bringing this action the owner of a dwelling house and lot in the *396borough of West Pittston, which was occupied by him and his family as a homestead. On the front part of the lot were located three elm trees which had been planted there for purposes of shade and decoration, and had grown to be of large size.
