This is a chancery action to determine which of 2 customers is entitled to a single space-heating service contract as the Michigan Consolidated Gas Company can only furnish gas for heating purposes to 1 of the 2 claimants. The facts are very much in dispute. The record shows that in the spring of 1951, Whiting Tubular Products, Incorporated, operating at 17740 Clairann avenue, Melvin-dale, Michigan, were planning on building a larger plant.
