The seventh ground of the amended motion for new trial was based on the alleged disqualification of Amos Meeks, as one of the jurors who participated in rendering the verdict, on account of his relation by marriage to David Harper, brother of the deceased and prosecutor in the case, within the prohibited degrees, such relation being unknown to defendant or his counsel until after verdict.
