OPINION

SAND, District Judge.

In this action for copyright infringement, the plaintiff, Eddie Palmieri, alleges that in 1981 he wrote and recorded a song “Pagi-nas De Mujer,” to which he holds the copyright, and which was released in the United States by Barbaro Records the same year. Defendants Estefan, Casa and Ostawald claim that they composed the song “Oye Mi Canto,” in 1989.
