The Maryland Department of Transportation, Motor Vehicle Administration (“MVA”), appellant, challenges an Order issued by the Circuit Court for Montgomery County, imposing a stay, a temporary restraining order, and a final injunction barring the MVA’s 90-day suspension of the driving privileges of Michael Baptist, appellee. 1 The MVA had imposed the suspension pursuant to Md.Code (2006 Repl.Vol., 2007 Supp.), § 16—205.1(b)(1) of the Transportation Article (“TR”), after a breath test showed that appellee was driving with an alcohol concentration of .20, in violation of TR §…
