This is an appeal from a judgment entered upon the verdict of a jury in favor of the plaintiff and against the defend*57ant, and from an order denying a motion for a new trial. The action is one for alleged negligence, whereby the plaintiff lost one of his hands. The accident happened on the 14th of August, 1893, at a place where a highway called “People’s Road” crosses the tracks of the defendant, at a point about one mile north of the village of Saugerties.
