This matter is before the court upon defendants' demurrer to the petition of the Board of Supervisors of Page County for a declaratory judgment. Plaintiff has sought a declaratory judgment of its rights and obligations concerning the payment of attorney fees incurred by a Special Commonwealth's Attorney in defending the Sheriff of Page County. The Special Commonwealth's Attorney was appointed by the Circuit Court of Page County.
