I. Introduction
On or about February 23, 2001, Calvin Baker (“Baker” or “Petitioner”) filed a pro se petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254 (“Petition”), challenging his December 13, 1996 conviction in Supreme Court, New York County, for robbery, burglary, and sodomy in the first degree. N.Y. Penal Law §§ 160.15[3], 140.3[3], 130.50[1]. Baker’s conviction was affirmed on September 30, 1999 by the Appellate Division, First Judicial Department, People v.
