Contracting of Woodside Corp., pending in the Supreme Court, Kings County, under index No. 42787/03, the plaintiff appeals from an order of the Supreme Court, Kings County (Schneier, J.), dated October 20, 2006, which denied its motion for summary judgment on the complaint and granted the defendant’s cross motion for summary judgment.
