ROGERS, Justice.

This is an action for the recovery of the amount of a policy of fire insurance, the statutory penalty, attorney’s fees, and an additional sum as damages for slander, libel and malicious prosecution. Defendant in its answer denied the alleged slander, libel and malicious prosecution and also denied any liability under the terms of the policy on the ground that plaintiff burned, or caused to be burned, the insured premises by some person or persons unknown to defendant for the purpose of collecting the amount of the policy.
