ORDER GRANTING DEFENDANT’S MOTION FOR SUMMARY JUDGMENT
ACOSTA, District Judge.
This is an age discrimination action instituted by plaintiff, WILFREDO MORENO MORALES (“MORENO”), pursuant to the Age Discrimination in Employment Act, 29 U.S.C. §§ 621-634 (“ADEA”) and its local counter-part, Act No. 100 of June 30, 1959, 29 P.R. Laws Ann. §§ 146-151 (2002) (“Act 100”) as well as Puerto Rico’s unjust termination statute, Act No. 80 of May 30, 1976, 29 P.R. Laws Ann. § 185a (2002) (“Act 80”).
