On October 4, 1910, the respondent began this action in the superior court of Spokane county, against the appellant, to recover the sum of $1,000, alleged to have been paid the appellant as part of the purchase price of certain merchandise which the appellant agreed to sell and deliver to the respondent, and which he failed to deliver. On the filing of the complaint, a writ of attachment was sued out, under which the sheriff who had the writ for execution levied upon and took into custody certain personal property belonging to the appellant.
