On July 29, 2011, the plaintiff, Debra L. Marquis, individually and on behalf of those similarly situated, filed this action against the defendant, Google, Inc. She alleges that she is not a user of Google’s email service — Gmail—and that Google violated the Massachusetts wiretap statute, G.L.c. 272, §99 (wiretap statute), each time it reviewed the content of emails that she sent to Gmail users or Gmail users sent to her.
