It appears from the record, that in August, 1874, Runyan held several notes, payable to himself, on Herman R. Allen. They bore date the 31st of July, 1874, payable in one, two and three years, and secured by mortgage on lands in Cook county, of even date, and duly recorded. Runyan, for a valuable consideration, indorsed to appellant, Ogle, and delivered them, with the mortgage, to him. In the spring of 1875 Runyan obtained a deed for the mortgaged premises from Allen, for the equity of redemption.
