—Judgment unanimously reversed on the law and new trial granted on counts 8, 9 and 13 of the indictment. Memorandum: On appeal from a judgment convicting him after a jury trial of two counts of rape in the first degree (Penal Law §§ 20.00, 130.35 [1]) and one count of endangering the welfare of a child (Penal Law §§ 20.00, 260.10), defendant contends that County Court committed reversible error by precluding the testimony of a defense witness who was in the courtroom during the testimony of a prosecution witness.
