This action was brought by the plaintiff to recover from the defendant damages by reason of the destruction by fire of certain property owned by the plaintiff alleged to have been started by the negligence of the defendant, his agents and employees. The answer denied liability for the fire, and also' set up' the affirmative defense of contributory negligence on the part of the plaintiff.
