MEMORANDUM OPINION AND ORDER

PHILIP PRATT, Chief Judge.

This is an action brought under 42 U.S.C. § 1983 arising from a shooting incident at the State Prison for Southern Michigan at Jackson, Michigan, the plaintiff alleging that he was deprived of rights guaranteed by the Eighth and Fourteenth Amend ments. On January 31, 1986, the jury returned a verdict for the plaintiff, assessing actual damages in the amount of $60,000 but denying the plaintiff any punitive damages. The defendants now move for a Judgment Notwithstanding the Verdict, or in the alternative, for a new trial.
