United States v. Jones
Court of Appeals for the Fifth Circuit

James Stephen Jones (“Jones”), a federal prisoner, appeals the denial of his pro se 28 U.S.C. § 2255 motion, in which he challenges his conviction for using and carrying a firearm in relation to the commission of a drug trafficking crime, in violation of 18 U.S.C. § 924(c)(1). Jones, who pleaded guilty to this crime, contends that there is an insufficient factual basis for his § 924(c)(1) conviction in light of the Supreme Court’s intervening decision in Bailey v. United States, 516 U.S. 137, 116 S.Ct. 501, 133 L.Ed.2d 472 (1995).
