Judge BAKER delivered the opinion of the Court.
Before a military judge sitting alone, Appellant pleaded guilty to one specification of battery and one specification of aggravated assault, both in violation of Article 128, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 928 (2000). The military judge accepted those pleas and entered findings of *58guilty. Appellant was convicted contrary to his pleas of one specification of rape, in violation of Article 120, UCMJ, 10 U.S.C. § 920 (2000).
