MISHLER, District Judge.
This action is brought by plaintiff for breach of alleged contract of employment. The complaint states four claims as follows:(1) Breach of a contract for life employment which contract plaintiff alleges was amended to provide for employment until such time as plaintiff attained the age of 65 years. Pursuant to paragraph three of a pre-trial order, made April 22, 1959, the Court directed that the allegations of the claim be interpreted to allege in the alternative, an employment from year-to-year.(2) The second stated claim is similarly phrased except that the gravamen…
