Error to the Circuit Court of Marshall County. Hon. J. W. C. Watson, Judge. This is an action of assumpsit brought by Sina D. Pinson against the “ Holly Springs Savings and Insurance Company,” whose name was changed, pending the litigation, to the “Bank of Holly Springs.” The object of the suit was to recover damages for the refusal of the bank to transfer on its books certain certificates of stock which had been assigned to the plaintiff by B. S. and William Crump.

The principal question raised by this record is whether the plaintiff in error, under its charter and by-laws, and the certificates of stock involved in this controversy, has a lien on the stock as against the defendant in error.
