Plaintiff Bethany Medical Center originally bi’ought this action against Dr. Robert C. Harder, former Secretary of the Kansas Department of Social and Rehabilitation Services. The action arises under Title XIX of the Social Security Act, 42 U.S.C. §§ 1396 et seq., and the Civil Rights Act, 42 U.S.C. § 1983. In this action, plaintiff has challenged the validity of the Kansas Medicaid Plan’s method of reimbursing costs for inpatient hospital services.
