The cause of action is set out in the plaintiff’s petition :as follows: “That on the 20th day of August, 1888, the defendant, being owner of the lands hereinbefore described, •did on said day, by Robert W. Patrick, his attorney in fact, enter into an agreement with the plaintiff partially oral and partially in writing, to-wit, in letters and telegrams, whereby the defendant agreed to sell to the plaintiff (here follows the description of a large number of tracts of land) in Nance county, Nebraska, for- the sum of $10,090, which said sum was to be deposited by the plaintiff in the Platte…
