After Scott Mihm filed a petition to modify their divorce decree, his former wife Melissa counterclaimed seeking an increase in child support. As part of the original stipulation, the parties agreed to a child support amount below that provided by the child support guidelines. The district court incorporated this stipulation into its decree of dissolution without noting that the child support was not consistent with the child support guidelines and without any explanation as to why application of the guidelines would be unjust or inappropriate.
