Appellant sued appellee to recover commissions alleged to be due him as a broker upon the sale of certain real estate. He alleges: That appellee listed the land with him at a price of $60 per acre, for the sale of which he was to receive his customary commissions of 5 per cent. That appellant had working under him in said business one J. R. Glenn, under an agreement by which the said Glenn was to receive a division of such commissions as were received upon all sales made to parties from a certain section of the state.
