Petitioner is a state prisoner assigned to Close Management residential status for spitting in the face of a psychiatrist attempting to interview him. The Department' form reporting the incident stated that Petitioner repeatedly cursed the doctor and staff, and when ordered to leave the doctor’s office, Petitioner then stood up and spat in the doctor’s face, requiring Department security staff to escort Petitioner out of the office and place him in confinement pending resolution of the incident.
