The appellee sued the appellant in the Superior Court of Marion County, Indiana, for damages for breach of a written contract in which contract the appellant agreed to pay a fixed sum for the privilege of exhibiting certain motion pictures and photoplays in the Walker Theatre in Indianapolis, Indiana. The alleged breach of the contract consisted of appellant’s refusal to accept, play, or pay for the motion picture productions for which it had contracted. The cause was tried by the court without the intervention of a jury and judgment rendered against the appellant in the amount of $850.00.
