The plaintiff’s action is founded on a parol agreement alleged to have been made by the treasurer of the defendant company to pay for a quantity of merchandise sold to C. D. Weller who had entered into a contract with the defendant for the erection of an addition to its plant. Two questions are raised: (1) whether the testimony takes the case out of the operation of the Act of April 26,1855, P.
