This is a timely appeal by Johnnie Clifford McDowell, hereinafter called defendant, from final order of the United States District Court for the Western District of Missouri denying without hearing his petition for habeas corpus. Defendant, at the time of filing his petition, was serving a life term at the United States Medical Center for Federal Prisoners in Springfield, Missouri, as a result of his conviction in the United States District Court for the Eastern District of Tennessee on an indictment charging kidnapping, aggravated by rape, in violation of 18 U.S.C.A. § 1201 (a).
