This is a direct appeal by the defendant, Jack B. Cremer, following a jury conviction of felony theft (K.S.A. 21-3701). The only point raised by defendant on the appeal is that the trial court erred in failing to sustain defendant’s motion to dismiss made prior to trial. The motion was based on defendant’s *595contention that the State’s evidence at the preliminary hearing was insufficient to show probable cause to hold the defendant for trial.
