We grant movant’s motion for rehearing, withdraw the opinion issued in this case on January 28, 2014, and issue this substitute opinion on rehearing.

On October 16, 2013, relator Jeffrey M. Stern, Individually and d/b/a Stern, Miller & Higdon, filed a petition for writ of mandamus in this Court. See Tex. Gov’t Code § 22.221; see also Tex.R.App. P. 52.
