This is an action o£ trespass, quare clausam fregit, from the Circuit Court of Grainger county, determined at the April term of said court, 1.854. Judgment for plaintiff, and defendant appealed in error to this court.

This was an action of trespass quare clausam fregit, brought by Rice and McFarland against Thomason, in the Circuit Court of Grainger, on the 6th of September, 1852. — The declaration charges, that “ on the 4th day of April, in the year 1850, and on divers other days and times. between that day and the commencement of the suit,” the defendant entered the plaintiffs close, and cut five hundred timber trees, of the value of $100.00, and made, and carried, away ten thousand rails, of the value of $100.00, &c.
