— In a proceeding pursuant to CPLR article 78 to review a determination of the appellant fire commissioner, which, after a departmental hearing, dismissed petitioner from the New York City Fire Department, and to compel the commissioner to reinstate petitioner in order to allow him to retire with pension benefits, the appeal is from a judgment of the Supreme Court, Kings County, dated April 14, 1980, which granted the petition.
