This action has arisen from a proceeding taken by the city authorities of Jefferson City to expropriate certain property of the defendant for the purpose of opening and extending one of the streets of that city. The report of the commissioners appointed to assess the damages that would ;e caused to the defendant from the •expropriation, being returned to court, its homologation was offered by the defendant. The report was confirmed by a judgment of the court; .and the defendant appeals.
