This is a petition in error, filed by leave in this court, to reverse the judgment of the district court of Cuyahoga county, rendered at its October term, 1854, in favor of the defendant in error against the plaintiff in error. The facts of the case are substantially as follows :
In the year 1839, William B. Lloyd executed his deed of mortgage, containing full covenants of seizin, warranty, and against incumbrances, for the nominal consideration of one dollar, but really to secure the payment in installments of $625, to Samuel Quimby, on 661 acres of land in Lorain county.
