Plaintiff filed a complaint in trespass averring that it is the owner and occupant of premises 128-132 North Eighth Street, Allentown, Pa., that its predecessor in title in 1921 under resolution no. 2226 of the City Council of the City of Allentown, obtained permission to connect its building with the storm sewer at Eighth and *425Linden Streets (a half block away) and pursuant thereto laid a pipe underneath Eighth Street at a depth of four to six feet, that the proper officers of the City of Allentown knew or should have known of the existence of the connecting pipe line, that…
