WINTER, Circuit Judge:

Gary Steven Florence was convicted by a jury of refusing to report for induction into the armed forces in violation of 50 U.S.C. App. § 462(a) on April 23, 1971. He was sentenced the same day to three years’ imprisonment and fined one thousand dollars.

In this appeal Florence contends (1) that he was denied his right to a speedy trial in that he was arrested on January 23, 1970, but was not brought to trial until April 12, 1971; (2) that remarks made by the district judge and a prospective juror prejudiced the jury and made it impossible for appellant to receive an…
