Under indictment number 2667-01 the defendant is charged with one count each of murder in the second degree, Penal Law § 125.25 (1); manslaughter in the first degree, Penal Law § 125.20 (1); criminal possession of a weapon in the second *412degree, Penal Law § 265.03 (2); and criminal possession of a weapon in the third degree, Penal Law § 265.02 (4).1 Under indictment number 5493-01, the defendant is charged with one count of murder in the second degree, Penal Law § 125.25 (2) (depraved indifference).
