delivered the opinion of the court.

Plaintiff brought an action in tort to recover damages caused by the freezing and bursting of water pipes in the premises he occupied as a tenant of defendant, alleging that this was caused by the negligence of the defendant, resulting in damages to plaintiff’s goods. Upon trial he had a verdict for $1,197.30, and defendant appeals from the judgment thereon.
