¶ 1. Randy Braswell sued Ergon Oil Purchasing, Inc., in Amite County Circuit Court over some oil contracts. Two days later, Ergon brought a declaratory judgment action (the subject of this appeal) against Braswell in Rankin County Circuit Court over those same contracts. Ergon then removed the Amite County action to federal court, where it remained for eighteen months before it was remanded.
