Factual Background:

The issue underlying this case is whether the failure of trial counsel to prove the defendant’s indigency and his subsequent inability to seek the opinion of a psychiatric expert as to defendant’s mental health entitled the defendant to post-conviction relief. Cornelle Williams was tried by jury and convicted of second-degree murder, assault in the first degree, and armed criminal action with respect to events that occurred on February 24, 2001.
