(dissenting) — This is the third time this matter has been before this court. The nature and character of the injuries which relator alleges he sustained are fully set forth in Crabb v. Department of Labor & Industries, 186 Wash. 505, 58 P. (2d) 1025, in which we decided that the department would have to entertain the claim referred to therein. Thereafter the supervisor considered the claim on its merits and entered an order February 2, 1937, making award as indicated in the majority opinion.
