*1310Appeal from an order of the Supreme Court, Onondaga County (Thomas J. Murphy, J.), entered March 30, 2005. The order, insofar as appealed from, denied those parts of defendant’s motion for summary judgment with respect to the second and third causes of action asserted by plaintiff Barber & DeLine, LLC and that part of defendant’s motion with respect to the fourth cause of action to the extent that it is asserted by plaintiff Barber & DeLine, LLC.
