dissent in a memorandum by Kassal, J., as follows: Petitioners, owners of a townhouse located at 186 Sullivan Street, New York, New York, had engaged respondent as a general contractor to perform extensive alterations to the premises. The written contract, entered into July 31, 1981, provided for progress payments to respondent in the total sum of $221,600, with the work to be completed by November 15,1981.11 According to petitioners, the progress of the job fell significantly behind schedule and, in addition, respondent’s work was found to be deficient.
