This action was instituted by plaintiff, Virginia Mohler, widow of Harold Mohler and administrator of his estate, against defendants, Robert W. Blanchette, Richard C. Bond and John H. McArthur, trustees of Penn Central Transportation Company (Penn Central), to recover damages under the Federal Employers’ Liability Act, 45 U.S.C. §51 et seq. (1970), for a violation of the Safety Appliance Act, 45 U.S.C. §1 et seq. (1970), which allegedly caused the. death of her husband. Plaintiff’s complaint was originally filed in 1970.
