Petition for a writ of mandamus to compel the respondent to pay over to the treasurer of the petitioner a fund received by the respondent under the act of Congress approved August 30, 1890. Hearing before Solmes, J., who reserved the case for the determination of the full court. The case was argued at the bar in January, 1892, and after-wards was submitted on the briefs to all the judges except Field, C. J.

By an act of Congress approved August 30, 1890, entitled “ An act to apply a portion of the proceeds of the public lands to the more complete endowment and support of the colleges for the benefit of agriculture and the mechanic arts established under the provisions of an act of Congress approved July second, eighteen hundred and sixty-two,” it was provided “ That there shall be, and hereby is, annually appropriated, out of any money in the treasury not otherwise appropriated, arising from the sales of public lands, to be paid as hereinafter provided, to each State and Territory for the more…
